Impeach Judge Kim McLane Wardlaw

Sidewalks don't flush. Urban renewal is more important than the homeless. The 8th Amendment barring of " cruel and unusual punishment" has nothing to do with clearing public walkways of sleeping bums.

Who would deny these statements? Judge Kim McLane Wardlaw does. She sits on the U.S. Court of Appeals for the 9th Circuit in San Francisco. She ruled in the majority of a 2-1 panel that invalidated a 37 year old ordinance in Los Angeles. Shw wrote in her opinion, " The 8th Amendment barring 'cruel and unusual punishment' prohibits Los Angeles from punishing involuntary sitting, lying or sleeping on public sidewalks that is an unavoidable consequence of being human and homeless without shelter." She is a moron.

The area in question in L.A. is 50 blocks square. It is called Skid Row. Recently there has been an urban renewal of part of that area. New apartments and condominiums have been built. That's good for the city and it's people. But the new inhabitants resent that homeless/bums have to be stepped over or avoided because they might be dangerous. Enter the L.A. Police to clean up the area. Then enter activist lawyers that are pro bums paid hansomely by the taxpayers. Then enter Judge Wardlaw.

One wonders about Judge Wardlaw's personal hygiene habits when she ignores the discriptions of what the downside is of sidewalks that don't flush. But one shouldn't wonder that she is incompetent and should be removed from the bench.

The problem with the 9th Circuit is that it has a liberal agenda. Now they are over ruling common sense health laws concerning such things as defecation in public! Where do you think they go your honor? The only reason these smug legal eagles champion bums is to take another swipe at our free market capitalistic society.

Why weren't Kim Wardlaws’ credentials produced in a timely fashion? Did she think she was above the law? Was she getting help her Democratic operative husband Bill Wardlaw?

Another Hottie Judge Decision

In City of San Diego v. Roe, the Supreme Court, in a per curiam opinion, unanimously reversed a nutty decision (pdf) from the Ninth Circuit. The Ninth Circuit had held that a police officer who was fired for making and selling a porn video in which he stripped off his police uniform and masturbated could advance a claim that the termination violated his First Amendment rights. A3G can think of several things that might have been violated -- but the First Amendment isn't among them!

The Ninth Circuit opinion that was reversed so peremptorily was written by Judge Raymond C. Fisher -- a member of the Elect, having clerked for Brennan -- and joined by female feeder Judge Dorothy W. Nelson. The absolutely fabulous Judge Kim McLane Wardlaw, the federal judiciary's #2 Superhottie and #1 Gay Icon, sensibly dissented. (A3G has heard that, in the past few years, Judge Wardlaw has been the Ninth Circuit judge most frequently vindicated in the Supreme Court. Can anyone confirm this?)

She is number 11 on the nominations for hottie justices with a brief bio.

Judge Wardlaw, 50 (as of July 2 -- happy birthday!), "looks like Barbie," "Heather Locklear in a black robe." This blonde Hispanic hottie boasts "a fantastic smile" and an "incredible body," showcased quite nicely by her "elegant ensembles." She was nominated by several UTR readers, including her husband, Los Angeles power broker Bill Wardlaw, a private equity kingpin at Freeman Spogli.

The Wardlaws are very wealthy, with a fortune well into the eight figures, and they are incredibly plugged-in, on both sides of the aisle. Bill Wardlaw and L.A.'s Republican former mayor, Richard Riordan, were extremely close (at least until their well-publicized falling out). Bill Wardlaw was thus described in this article as "the Riordan administration's eminence blanc, a pale, brilliant, almost Jesuitical political tactician, the father to two of the mayor's godchildren." On the Democratic side, the Wardlaws are close friends of current L.A. mayor Jim Hahn, whose mayoral campaign was chaired by Bill Wardlaw, as well as Bill and Hillary Clinton. Indeed, the Wardlaws have graced the Lincoln Bedroom with their presence. An "FOB" ("Friend of Bill"), Judge Wardlaw was appointed by President Clinton to the district court in 1995, then swiftly elevated to the Ninth Circuit in 1998.
